1. About these Terms
These Terms of Service ("Terms") are a contract between you and Eshed Yaacov, trading as funApps, based in Israel ("Pulse", "we", "us"), covering your use of the Pulse website, web app and API (the "Service").
By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you don't agree, don't use the Service.
If you use Pulse for a company, you confirm you can accept these Terms on its behalf, and "you" includes that company.
2. Who can use Pulse
You must be at least 18 and able to enter a binding contract. Pulse is a tool for marketing products and businesses.
Keep your account details accurate and your login and API keys secret. You are responsible for everything done through your account, so tell us right away at [email protected] if you suspect someone else is using it.
3. What Pulse does
Pulse is an AI marketing assistant. It researches your niche, drafts TikTok carousel posts, reads the results you share, and uses them to plan your next batch.
- You publish, not us. Pulse never connects to, logs into or posts from your TikTok account.
- No guaranteed results. We don't promise views, followers, downloads, sales or any other outcome. Organic reach depends on things we don't control, including TikTok's algorithm and rules.
- The Service evolves. We may add, change or remove features. Features marked beta may be less reliable.
4. AI-generated content
Pulse uses third-party AI models, including models from Anthropic and Google, to create text and images ("Output"). You can choose among the models we offer.
- Check before you post. Output can be inaccurate, outdated, offensive or unsuitable. Review and edit every post before publishing it.
- Output isn't unique. It can resemble content made for other users or found online, and others may receive similar Output.
- Data can be wrong. Research results, public post metrics and numbers read from your screenshots can be incomplete or mistaken.
- Not professional advice. Output is not legal, financial, medical or other professional advice.
- Watermarks and labels. Some AI providers embed invisible watermarks or metadata in images, such as Google's SynthID. TikTok and other platforms may label your posts as AI-generated on their own, and we don't control those labels.
5. You're responsible for what you post
You are the publisher of everything you post, whether Pulse drafted it or not. Before posting, make sure it follows TikTok's Terms of Service, Community Guidelines and branded content rules, and the advertising, consumer protection and endorsement laws where your audience lives.
- Founder stories. Pulse can write your story from what you tell it, or generate a fictional one in a style you choose. A generated story is fiction: don't present it, or any invented testimonial, result or experience, as real when that would mislead people. Doing so can break consumer protection laws and platform rules.
- Disclosures. Pulse's reminders to label AI-generated or promotional content are optional and off by default. Whether they're on or off, labelling your posts as the law and platform rules require is up to you.
- Product claims. You're responsible for every claim about your product, especially health, financial, safety or performance claims.
- Borrowed wording. Pulse may suggest hooks, calls to action and phrases common in your niche, sometimes word for word from public posts. We don't check Output for originality or third-party rights, so don't copy other creators' distinctive content or use trademarks, likenesses or music you don't have rights to.
6. Your content and our licence
You keep ownership of what you give Pulse ("Your Content"), such as product details, your founder story, uploads, links, chats and API submissions. As between you and us, you also own the Output made for you, to the extent the law allows anyone to own it, and you can use it for any lawful purpose, including commercially.
- Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Your Content and Output, only to provide, secure and improve the Service. This includes sending it to our AI and research providers as our Privacy Policy describes, and it ends when you delete the content or your account, apart from the backups and records that policy lets us keep.
- Aggregated learning. We may use results and content in aggregated, de-identified form to improve Pulse for everyone, for example to learn which hook types tend to perform. This never reveals your identity, your product or your content to other users.
- Your rights to share. You confirm you have the rights and permissions needed for Your Content, including images, logos, screenshots and any personal data in it.
- Your users' data. If you send us data about your own users through the API, such as answers to an attribution question, you're responsible for informing them and having a legal basis to share it. Send only what Pulse needs; we process it only to provide the Service to you, and you can contact us for a data processing agreement.
7. Acceptable use
Don't use Pulse to:
- break any law, or infringe anyone's intellectual property, privacy or publicity rights;
- create illegal, hateful, harassing or violent content, sexual content without consent, or any content that sexualizes minors;
- create deepfakes, impersonate real people or brands, or expose someone's private information;
- deceive people, for example with fake reviews or testimonials presented as real, scams, or false health or financial claims;
- send spam or commit fraud;
- upload malware, probe or attack our systems, or scrape the Service;
- get around credits, rate limits, paywalls or safety filters, including by jailbreaking AI models;
- open multiple accounts to collect free credits, or share or resell access without our permission;
- reverse engineer the Service where the law doesn't allow it, or copy it to build a competing product;
- break the usage policies of our AI providers, including Anthropic's and Google's.
We may review, block or remove content, refuse to generate it, or limit or suspend your account if we believe you've broken these rules.
8. Plans, credits and payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also governed by Paddle's Buyer Terms.
- Plans. Pulse offers a free plan with a one-time grant of credits, and paid plans with credits each billing period, as shown on our pricing page.
- Credits. Research, carousel generation, analysis, chat and API calls use credits at the costs shown in the app. If a generation fails, we return its credits. [Unused credits expire at the end of each billing period.] Credits have no cash value and can't be transferred, and we may change credit costs with at least 14 days' notice.
- Renewal and cancellation. Paid plans renew automatically until you cancel. You can cancel anytime in your account settings or through the link in your Paddle receipt, and your plan stays active until the end of the period you paid for.
- Free trials. If we offer a trial, we'll show the price and end date before you start. It turns into a paid plan unless you cancel before it ends.
- Prices and taxes. We'll give at least 30 days' notice of a price change, which applies from your next renewal. Paddle adds and collects any VAT or sales tax due.
- Refunds. Our Refund Policy explains when and how you can get your money back. If a payment is refunded or reversed, we may remove the credits it granted. Nothing in these Terms limits rights you have under consumer protection law.
9. The Pulse API
You can use the Pulse API with your own tools and AI agents. You're responsible for every request made with your API keys, including requests your agents make for you.
API use consumes credits and is subject to rate limits. We may change or retire endpoints, and we'll give at least 30 days' notice of breaking changes where we reasonably can.
10. Third-party services
Pulse is not affiliated with, endorsed by or sponsored by TikTok, ByteDance, Apple or our AI providers. Your use of TikTok, App Store Connect and other platforms is governed by their own terms.
We aren't responsible for those platforms' content, availability, rule changes or decisions, such as removing or labelling a post or restricting your account. Research data and public metrics come partly from third parties such as Virlo, and may be delayed, incomplete or unavailable.
11. Our intellectual property
Pulse, including its software, design, prompts, research methods and brand, belongs to us and our licensors. We give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service under these Terms, and we keep all rights we don't expressly grant.
If you send us ideas or feedback, we may use them freely without owing you anything.
12. Copyright and other rights complaints
If you believe content created or stored through Pulse infringes your rights, email [email protected] with:
- your name and contact details;
- the work or right you own;
- where the infringing material is;
- a statement that you believe in good faith the use isn't authorized, and that your notice is accurate.
We'll review each notice promptly and may remove the content. We suspend or close the accounts of repeat infringers.
13. Suspension and termination
You can stop using Pulse at any time. To close your account, cancel any subscription and email us, or ask us to do both.
We may suspend or close your account, with notice where reasonable, if you materially breach these Terms, don't pay, create a security or fraud risk, repeatedly or seriously break our policies, or if the law requires it. If we shut Pulse down entirely, we'll give at least 30 days' notice and refund any unused prepaid fees.
When your account closes, your right to use the Service ends and we delete your data as our Privacy Policy describes, so export anything you want to keep first. Sections that by their nature should survive, such as ownership, disclaimers, liability limits and dispute terms, continue to apply.
14. Disclaimers
To the extent the law allows, the Service and all Output are provided "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and accuracy.
We don't guarantee that the Service will be uninterrupted, secure or error-free, or that Output or results will meet your expectations.
15. Limitation of liability and indemnity
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, followers or goodwill. Nor are we liable for actions taken by TikTok or other platforms.
Our total liability for all claims relating to the Service is limited to the greater of what you paid for the Service in the 12 months before the claim, or USD 100. These limits don't apply where the law doesn't allow them, such as liability for fraud or wilful misconduct, or to your statutory consumer rights.
To the extent the law allows, you'll compensate us for claims, losses and costs, including reasonable legal fees, arising from Your Content, the posts you publish, or your breach of these Terms or the law.
16. Changes to these Terms
We may update these Terms. We'll post the new version with a new date and, for significant changes, notify you by email or in the app at least 14 days before they take effect.
If you keep using Pulse after that, you accept the changes. If you don't agree, stop using Pulse and cancel your subscription.
17. Governing law and disputes
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. The competent courts in Tel Aviv-Jaffa, Israel have exclusive jurisdiction over any dispute about these Terms or the Service.
If you're a consumer, you keep any protections the mandatory laws of your country give you, including the right to bring a claim in your local courts. Before going to court, please email us so we can try to resolve the issue informally within 30 days.
18. General terms
- Entire agreement. These Terms, our Privacy Policy and our Refund Policy are the whole agreement between us about the Service.
- Transfer. You can't transfer these Terms without our written consent; we may transfer them to whoever takes over Pulse.
- Severability and waiver. If a court finds part of these Terms unenforceable, the rest still applies, and not enforcing a term right away doesn't waive it.
- Events outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control, including outages at our providers.
- Notices and language. We send notices to your account email address. If we translate these Terms, the English version controls.
